Lead-Based Paint

      

Lead Warning Statement


Every purchaser of any interest in residential real property on   which a residential dwelling was built prior to 1978 is notified that such   property may present exposure to lead from lead-based paint that may place   young children at risk of developing lead poisoning. Lead poisoning in young   children may produce permanent neurological damage, including learning   disabilities, reduced intelligence quotient, behavioral problems, and   impaired memory. Lead poisoning also poses a particular risk to pregnant   women. The seller of any interest in residential real property is required to   provide the buyer with any information on Lead-based paint hazards from risk   assessments or inspections in the seller’s possession and notify the buyer of   any known lead-based paint hazards. A risk assessment or inspection for possible lead-based   paint hazards is recommended prior to purchase.


Policy
It is the policy of Land Trust that it will disclose, to any   purchaser of a residential property other than properties known to have been   built after 1977, any known lead-based paint and/or lead-based paint hazards   present on the property.


It is further the policy of Land Trust that   it will provide, to any purchaser of a residential property other than   properties known to have been built after 1977, any reports or records   pertaining to lead-based paint and/or lead-based paint hazards which it has   available, if any.


It is further the policy of the Land Trust of   Jackson County that any purchaser of a residential property, other than properties   known to have been built after 1977, shall be provided a copy of the brochure   published jointly by the U.S. Environmental Protective Agency, the U.S.   Consumer Product Safety Commission, and the U. S. Department of Housing and   Urban Development titled Protect   Your Family From Lead In Your Home.


It is further the policy of the Land Trust of   Jackson County that any purchaser of a residential property, other than   properties known to have been built after 1977, may cancel the sale at any   time up to 10 days after the sale closes, if the purchaser has conducted a   risk assessment or inspection for the presence of any lead-paint problem and   if the presence of lead-paint or some risk related to lead-paint is found. In   the event of any such cancellation, the full amount paid by the buyer,   including any fees, will be refunded.


The applicability of this policy is part of   the consideration received by buyers and is enforceable against Land Trust.
